Exclusion from Mandatory Co-Parenting Programme (CPP)
The Women's Charter allows applicants to be excluded from the Mandatory Co-Parenting Programme (CPP), if they lack mental capacity.
Mental incapacity is defined as the inability to make a decision in relation to a matter because of an impairment of, or a disturbance in the functioning of, the mind or brain. A person is considered to lack mental capacity if there is a valid assessment by a certified medical practitioner that the person is unable:
- to understand the information relevant to the decision;
- to retain that information;
- to use or weigh that information as part of the process of making the decision; or
- to communicate his/her decision (whether by talking, using sign language or any other means).
